6. Payment and Billing

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OR FREEDOM FROM VIRUSES
• RESULTS OR OUTCOMES FROM USE OF THE SERVICES

We do not warrant that the Services will meet your requirements or that any information provided is suitable for investment or business decisions. You are solely responsible for evaluating and acting on information from the Services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 15ROCK SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• COST OF SUBSTITUTE GOODS OR SERVICES
• BUSINESS INTERRUPTION OR LOSS OF GOODWILL

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO 15ROCK IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless 15Rock and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Your Customer Data or content
• Your negligence or willful misconduct

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at legal@15rock.com. We will attempt to resolve the dispute informally within 60 days.

13.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive the right to participate in class actions or class-wide arbitration.

13.4 Governing Law
